Hi, Margaret!

Guess where I am? The U.S. Copyright Office! :) Actually, I'm at a teacher institute at the Library of Congress--so meeting folks from several depts is part of the program. It is wonderful to finally feel good about a couple of copyright questions...and you were right about the ones I asked you n the past--so thank you!! I hope to post my poems and songs units after I get home :)

I'm afraid not. If you scroll to the bottom of the website page, you'll see their copyright notice. That includes the pictures. You might want to contact them and see if they will give you permission to use them. They just might!

I'm curious to know your thoughts on the following: I'd like to gather common folk tales from various countries, create my own rendering, translation, and illustrations, and add supplemental resources and activities to aid in language teaching. I would of course cite the works that inspired my own telling. My research suggests that this is a legitimate and dignified approach. Do you see any potential pitfalls on TpT?

I am getting ready to create unit materials to highlight Lynne Cherry's books, and I looked up the titles I'm interested in creating activities for. I was shocked to see so many units using the book jackets for The Great Kapok Tree and A River Ran Wild as the unit cover pages. The Great Kapok Tree alone had 10 violations I saw. If a unit is "flagged for copyright violation", what happens? I think in most cases the sellers just don't know, and I debated notifying them. I think it'd come off funny since I typically sell book units and would be competing against them though. In my opinion, these units should be removed until they are in compliance. Just curious what your opinion on this matter is.

At one time TpT has requested that we not contact other sellers about copyright violations, but I don't know if they still feel that way. There are way too many items like the ones you found! Obviously not copyright compliant, and you don't know if the person doesn't know any better or is doing it on purpose. So irritating!
When you flag an item for copyright violation, it think that calls it to the attention of someone on the TpT staff, but I don't know what the next step is. Unless you know this seller personally from a blog or a Facebook group, I would suggest that you not leave any kind of notification. It's hard to walk away from this sort of stuff, but it DOES save a lot of time and fretting if you can do it!

I have finally trained myself to concentrate only on keeping my work as copyright legal as possible and let everybody else do the same. That doesn't mean it's easy. I still want to yell at people!

Thanks, Margaret! All the pamphlets and brochures that I use are printed from Spain, Mexico, Panama, etc. I'm sure each country would have its own law regarding the status of these being copyrighted materials. Hmmmmm... Thanks again!

I think I would try to contact the producers through e-mail about using their brochures, but if you can't find an address or don't get a response, I would go ahead. This idea is simply too creative and kid-friendly to drop!

I have started using brochures from Mexico and Spain to create reading comprehension activities, internet activities, and such. Many of these are Powerpoints which use scanned images of brochures from companies. Some of these companies are 'mom 'n' pop' types of places and I'm sure those are fine. However, could I sell PowerPoints with copies of brochures from companies like KFC Mexico, Subway in Mexico, etc.? There are no copyright symbols on the brochures. Thanks for your assistance. It appears that brochures ARE copyrighted, regardless of who creates them, in the US.

Are the brochures you are using created in the US or in Mexico and Spain? I think it would be a good idea to contact the people who created the brochure and tell them how you want to use it. I think they would be more than happy to have their brochure used in that way.

This is an excellent idea, by the way! Kids will not be able to resist!

Update: I was on the Kagan site. http://www.kaganonline.com/workshops/copyright.php They may allow adaptations of their products but it requires permission and a sample of the actual product. There is a product permission request form that teachers must submit with the product they want approved. :)

Thanks again Margaret. :) I think I am understanding you. However, I called the publisher of the book, "Better Learning Through Structured Teaching - A Framework for the Gradual Release Model" by Doug Fisher and Nancy Frey. The paralegal informed me that methodology or concept is not copyright protected. She said that it is better to use the names, such as Gradual Release Model and for Kagan - to say that they are for use with the Kagan strategy, such as a quiz quiz trade, rather than renaming it something else. That way, I am giving credit to the people who developed the idea and I am just using the concept with my own original work. I am not sure if that is what you meant or not so I thought I would re-clarify. I am going to try to contact someone at Kagan to see if they are OK with my sharing my own quiz quiz trade cards before I share them. I will keep you posted. :) Thanks!

Thanks for your prompt reply Margaret. I use "thinking maps" a lot in my classroom because it is a required school improvement goal. I assume then that I can include thinking maps in my units as part of a product for TpT as long as I don't call it a "thinking map" packet but rather refer to it as an "organization guide" within my unit as you mentioned. I was also wondering about Kagan activities and the gradual release model. We use a lot of Kagan cooperative learning here. I have made quiz quiz trade activities and lessons that include Showdown or Numbered Heads Together. Could I refer to the Kagan terms in a product or can I use the structure (such as quiz quiz trade) but call it something else? For the gradual release model, could I share the products I use to implement the gradual release model and label it as such including the I do, We do, You do together, You do on your own)?

I would NOT recommend using the format or the name of another product in a TpT item. Even if you change the name, if you use the same format, techniques, or organizational methods of another product, you are using copyrighted material. You can used the IDEA behind these products to develop your own format or way of presenting the idea. That would not be an infringment.


Copyright can be so confusing. Hope I am helping rather that confusing!

I did a search on TPT for thinking maps and lots of items showed up. In the packet, it said that on 6/25/12, TpT got a cease-and-desist letter about thinking maps. That was 10 months ago. Why are their still so many items out there?

Good question!! TpT is working on this problem. I believe the problem with the "Thinking Maps' was using the name and the format that is given away free to teachers in workshops as for-sale TpT products. The term "thinking map" can be used on an original product, but not on a product based on this particular program. There are a lot of other terms that could be used instead of "Thinking Map." "Thinking Guide" "Organizing Guide" "Writing Map."

Hope this answers your question. There are quite a few items still on TpT that are not copyright compliant. Paul and his crew are working with a legal team to figure out how this problem can be solved. They cannot just decide something is a copyright infringment and take it down. That would REALLY get TpT in a legal mess.

I, for one, hope they get this particular road bump smoothed down ASAP!!

Hello Margaret.
I was wondering if posting smartboard activities created by me, but using the smartboard software would be an infraction of copyrights. For example, creating a spinning wheel for verbs conjugation (in Spanish and French), I use the spinning wheel from the smartboard gallery, but I introduce the verbs, colors, fonts, etc.
I just posted two activities like this, and I would like if there's a copyright infraction, in order to remove them if necessary.

I think that would be perfectly OK. To me, it would be the same as using Microsoft word formatting to create a document, which I do all the time.

Hearing all the wonderful things teachers are doing with smartboards makes me wish I was still in the classroom. I would love to try out all the new technology, but I like my retirement and time to write even more!

I have been teaching 6th grade language arts for many years. Next year I will be teaching 1 hour of 6th, 1 of 7th, and 1 of 8th. I will then have other duties in the afternoon that remove me from the classroom. I completely reworked my entire curriculum for next year before I knew of this change. I worked it around 4 books: Bud, Not Buddy, Among the Hidden, Devil's Arithmetic, and Out of the Dust. I found wonderful guided curriculum for 2 of them at Secondary Solutions and plan on focusing on those 2 for a huge chunk of time because the lesson seems to cover about a 9 weeks for each. The other 2 I have a few things to do with, but that is ok because I want to do some technology things and writing assignments. I would like to do my 7th and 8th grade class in the same manner. Find 3 books for each of them and curriculum already built and then do more writing for those grades to prepare for writing tests.
I planned on buying the common core posters for 6th grade and posting them in my room. As they are met by the students placing a star on them to show it was achieved. Dont think I can hang 3 sets of standards for 3 grade levels...not that much wall space. I am new at teaching 3 grades and 3 different lessons....any advice?

I have teaching materials for Bud, Not Buddy, Among the Hidden, and Out of the Dust in my store. Thought I do not have CCSS listed in the units, each of them is easily aligned.

As for the standards posters with stars, why not create a booklet of posters for each student with some sort of ring attachment that will allow you to display them on a peg board (or some other type of display). The students could even design the covers of their booklets and change them as the year progresses if they like.

I was wondering if you knew any websites that offered free clipart that I can use on my documents and it will be alright to post on TpT?

Also, I have read in magazines ideas about different classroom activities to teach a variety of lessons. I used the activities in my classroom, but came up with my own worksheet for it. Is that a copyright issue? I get nervous posting anything because I don't want to get into trouble.

Hi Nicole,

Right off hand, I don't know of any website that offers clipart free for use on TpT. I subscribe to several clipart services. Graphics Factory is my favorite, it is 100% TpT friendly, and it's only $40 a year. You might also want to go through TpT's clipart selection and see if you can find something there. Sellers are putting very low prices on the clipart.

I think you will be OK with the lessons you based on a magazine idea if your worksheets can be used without the magazine lessons. You would be putting your spin in an idea, which can't be copyrighted. But, if the worksheet requires the magazine lesson in order to make sense, it probably shouldn't be posted on TpT since the magazine lesson is copyrighted material.

Hi, Margaret! It's Shelby --who asked you several copyright questions this summer about my poems and songs related to war. I still hope to post those soon. In addition, I hope to post some other plans I have created except I have a coupla more questions. With the new Common Core and strong push for more and more nonfiction, my district wants us to use 'paired readings' as a teaching tool---a nonfiction piece paired with a poem is a typical arrangement. The nonfiction piece may be 5 paragraphs from a selection. If I wanted to sell a 'paired reading' would there be a copyright issue with 5 paragraphs from a selection? Is there any copyright allowance for publishing x number of sentences, paragraphs, pages of a piece without infringing on the copyright laws (you know with music sometimes it's okay to use it if you only use 30 seconds, etc?) What is the best way of knowing if any part of a text is okay to copy a few paragraphs ? (i.e. adolescent novels & nonfiction--hardcopy and online sources)?

You have asked a good question, and one I don't know how to answer and be confident that I got it right.

I often quote a line or two from the novel that I'm working up in order to tie it to a question or activity, but I never quote more than that. I would think that whole paragraphs would be fine for classroom use (Fair Use), but not for a commercial product. You might want to Google some questions about this topic. I'll go see what I can find.

Thanks for this copyright booklet, it's extremely helpful as I am new to TpT. I have one question that wasn't specifically addressed that I hope you can answer: I don't use clipart, I draw my own pictures and artwork. Is it ok to draw our own pictures based on picture books to be included in our materials (ie any picture book other than those trademarked that you mention specifically such as Elf on the Shelf, Dr. Seuss, etc.)?

If you do look-alike drawings of the characters and settings in the picture books, I think that would still be a violation as it would be a "copy" of the original illustration. However, if you draw totally new illustrations to accompany the story, then you would be 100% legal.

I also have this particular site on my list and I think I have used a couple of images from their catalog. They seem to be legal. Most of my images now come from Graphics Factory. Their subscription fee is very reasonable and they specifically list TpT as places where their clipart can be used. You do have to keep your subscription current, however.

I don't think you will need to pull your products!!

I also wanted to ask you a last thing...
In general, for those books that are trademarked... What can I exactly do with a book that is trademarked? I know it means that they have all the rights... but does it mean that I can't do any activitivies with this product (unless for personal use)? I was researching on a lot of children's books, and I found that a lot of them are trademarked... I tried looking up if I can create activities that are inspired with these books (not including a look-alike clip art), but I couldn't find any specifications.. Do you know any website that can give me more information and can educate me more on trademarks?

Chrildren's picture books are a chore to figure out. If they come with "external" merchandise, such as the Elf on the Shelf, it's probably a good idea to stay away from them. Pete the Cat is another example. If it's just the book, then activities would probably be OK. Of course any images of the characters or of the book cover is not allowed without specific permission from the publisher and/or author. As a general rule, publishers say "no!" I work with novels intended for 4th -8th grades, and don't run into the outside merchandising or character image issues. Primary people have a lot more to think about.

By the way, I have recently had to give up my favorite clipart resource (they don't want their stuff on TpT!) and switch to Graphics Factory. You will probably find clipart on TpT with plenty of art work to illustrate your book activities, but if you don't, I highly recommend Graphics Factory. They are only $40 a year, and they are TpT friendly. They even say so in their terms of use.

I like http://www.trademarkia.com/ for checking to see if something is trademarked. Some of the information is confusing, but generally, I can figure out if something would be leagle for TpT or not.

Hi Mrs. Nicolau,

I think in the case of Dr. Seuss some look-alike clipart is what started the whole deal. Dr. Seuss Enterprises contacted the clipart supplier and forced them to remove it from their products. This impacted lots of TpT products that had to be removed or reworked because of the clipart. Another teacher was contacted by Dr. Seuss Enterprises and ask that she remove the picture of the Seuss-inspired bulletin board she had posted on her blog. These people are mean!!!

I did a little research and found that their images, stories, even the book titles are copyrighted and trademarked. Everybody just agreed together that Seuss was too much trouble and off limits.

The Seuss products on the site indicate that not everybody got the word. I have a feeling, given the new Forum discussion chain on this topic, that all Seuss products will eventually be taken down and no more Seuss posting will be allowed. I think you would be better off not posting any Seuss stuff.

It's OK to use it in your classroom, but selling it or giving it away for free is a whole other story.

I have a list of titles, but my list is based mostly on which novels I have multiple copies of. A couple of titiles I am looking for right now would be Wringer, Little House on the Prairie, Frindle, Summer of the Swans, The Witch of Blackbird Pond, Pinballs. With each title I am creating a student workbook to complete as the novel is read. The workbooks include vocabulary activities and short answer questions for each chapter or group of chapters. I use the objective tests as "quizzes" throughout the novel. Your materials are exactly what I am looking for.

A while back ago, I had my Elf on the Shelf product deactivated by TpT. (I was unaware that we couldn't have products related to this book.) My question is, should I completely remove it from my store? Or just leave it as "inactive?" I'm curious because if people rated that product and/or my actual store, I don't want my overall store rating to go down if I remove it.
BUT, I also don't want to leave it in my store as "inactive" if that's going to get me in trouble with TpT.

At this time, I have 85 different titles worked up. 30 of them are what I call my Novel Teaching Packs--the ones with 7 different components. Just did a quick inernet search and found that this spelling program is copyrighted and the title is trademarked. They also provide supplementary materials for the program. All of these factors mean that creating new worksheets/activities would be a copyright and trademark violation. Since they provide their own teaching materials, your work would be in direct competition. By law, you are not allowed to profit from this program. This program is not a legal candidate for TpT products.

Sorry. I bet you have already created a lot of extra materials for this program, but they shouldn't be posted on TpT.
You are SO WISE to check on this before you posted. There are a lot of sellers having their products taken down because they are copyright infringments. That has got to be super frustrating!

Several years ago, I did find information on the internet that indicated the Microsoft clipart that came with Word could be used in commercial products, and I even included that information in a newsletter. But things seem to have changed! All information now says that the Microsoft clipart is for classroom ue only! I would stay away from the Mocrosoft stuff and purchase from your fellos sellers or subscribe to Graphics Factory. They are only $40 a year!

I am creating a vocabulary study project for a classic novel. In doing so, I am using a short passage, highlighting words in the passage and providing vocabulary acquisition activities to build vocabulary, as well as practice exercises that mimic the approach on high-stakes tests. If the novel is in the public domain, you can use all of the passages you want in your vocabulary study. (check Project Gutenberg at www.gutenberg.org to see if it's listed.) I think using the short passage, even if it still is under copyright law, would be OK.

If you mean you have written a theater script for the book, then you cannot use that in your packet. A novel study guide must be entirely different from the book--that is, it does not retell the story, but offers ways to understand and intrepret it. Retelling a story for profit is a copyright infringment.

It's not a good idea to use pictures you have pulled from the internet in your TpT products. They are probably copyrighted. You would need to contact the owner to get permission to use them in a product you sell.
Check TpT to see if anybody is selling the kind of photos you need. Classroom Clipart also has some good photos.

You claim copyright on your writing, but you cannot claim copyright on anything in the public domain, including clipart. The best way to find the public domain clipart is to Google "public domain clipart." There are all sorts of possibilities. I use OpenClipArt.com occasionally.

I would think screen shots of the book would be a copyright violation as it reporduces the cover image, which is copyrighted. You would, essentially, be using and profiting from someone else's original work.

If would think the name of the book and the author would be enough to identify the book. You could also include its ISBN.

TEACHING EXPERIENCE

Immediately after graduating from Lenoir Rhyne College in 1965 with a degree in high school business education, I touched ground and taxied into a self-contained elementary classroom filled to the brim with 38 eighth graders. Not the place I had planned to spend the next thirty years, but unwittingly, I landed where I belonged! Most of my thirty years in education were spent living happily in the delightful, chaotic, but always interesting world of sixth, seventh, and eight graders. For three of those years I served as a facilitator for gifted education in twelve elementary schools, where I worked with fourth, fifth, and sixth graders and dozens of teachers. During the last phase of my career, I traveled to schools throughout western North Carolina and presented workshops based on a program for teaching composition skills that I authored and used in my classroom. In 1997, after retiring from the classroom, I founded Taking Grades Publishing Company and began a second career writing teaching materials for middle grade language arts teachers. The company has enjoyed steady growth and can now claim customers in all fifty states, several Canadian provinces, and even Taiwan! Joining the TeachersPayTeachers team in November 2008 was the beginning of my third career in education. Once a teacher. Always a teacher!

MY TEACHING STYLE

My teaching style would probably be classified as traditional in that I absolutely loved presenting a well-prepared lesson standing on my feet, facing my class, answering every question (twice), and circling often for special effects. Then I enjoyed watching and listening when my students packed up what I had taught and went exploring. I was progressive in that I kept an open mind for new ideas. I certainly tried and tested many current theories during my career (1965-1995). If there was a better way, I wanted it for my students, and I constantly incorporated new techniques and theories into my teaching. But the basics never really changed for me. Stand up and teach! Watch 'em go! Humor was always welcomed and encouraged in my classroom. How much better to go home exhausted from laughing than just exhausted! At the end of the day, if I had allowed my students to teach me at least as much I had taught, then I had been a good teacher.

Graduated from Fred T. Foard High School in 1962. Attended Lenoir Rhyne University 1962-1965. Graduated on the third Friday in August 1965 and begin teaching the next Monday, two days later.

ADDITIONAL BIOGRAPHICAL INFORMATION

North Carolina is my home, always has been, always will be. I live in Conover, a small town located in the foothills of the Appalachian Mountains. My home is the same one I bought thirty-five years ago as a starter, but it's OK. I am not finished with it. My first love is teaching, and I spent thirty happy years in the classroom as a middle school language arts teacher. To this day, I still am amazed that I actually got paid for doing something that I thought of as a natural part of my life. It was never a job. Ask anyone who knows me. Children and animals have always been my passion. During my teaching years, I served as secretary and president of the local humane society. There has always been at least one cat on my lap and a few others circling in a holding pattern. After retiring from teaching, I decided to pursue my long-time dream of writing teaching materials professionally. Along came my company, Taking Grades, the World Wide Web, some extremely sharp learning curves, and my dream grew into a reality. On the internet I am known as Margaret at Taking Grades, but in the community I am known as the bird lady. There is a good explanation. The same year I began writing, I also developed an interest in wildlife rehabilitation. Today I am a fully licensed wildlife rehabilitator, specializing in orphaned and injured songbirds. Each season, from April to the end of August, I take in around 150 little ones (robins, blue jays, blue birds, Carolina Wrens, chickadees, cardinals) anything claiming to be a songbird, raise them to adults, and release them back into the wild. My home office does double duty as a baby bird nursery from spring to late summer. I am withholding this information from the cats!
