School Lawsuits by angry and grieving parents who have lost their children to school shootings and other violent acts, are working their way into our nation's court system, with the coming summer months being a good time for lawyers to conduct pre-trial Depositions.
Violence in our schools, including the horrific tragedies brought onto campuses by students wielding guns, still remains the highest and worst threat to the safety and welfare of our children. Is your school as safe as it ought to be? Do your classroom doors lock from the inside or from the outside? Does your Principal or other Administrator schedule regular periods of School Safety training? Do you document and share notes about angry adults or students who call your school, with blame and accusations? How open is your campus? Could a stranger find his way to the Main Office or to any classroom on your campus? What is the level of Bullying on your campus...high, low, moderate, or nonexistent?
It is never too soon to make plans that make your school SAFER.
It takes only ONE child to raze a "village," that is, to destroy your school. Unspeakable acts of violence can turn your school yard into a grave yard. And angry and grieving parents can force you into court and sue for justice. The core argument they will make is that the school failed in its "in loco parentis" obligations. That means they will allege that, as care and protection provider "in place of the parents" ("in loco parentis"), the school failed to execute its proper and complete duties.
