PROMPTZ© are picture and auditory clues that, when embedded into Language and Math activities, enable students to become actively and educationally engaged (individually, small group, whole group) by connecting the world they live and the things they know about to the skills we teach. The extensive ‘prior knowledge’ our students have encompasses much more 'environmental print' than stop signs and cereal boxes!
These ‘picture and auditory clues’ (thousands) have been legally collected and are readily accessible, interactive, self-selecting, ever-changing, manipulative icons that may be utilized in lessons and activities for virtually every state and national standard including technology, science health and social studies! You can easily keep your collection current by adding new (or deleting out-of-date) ones!
This extensive library or collection of thumbnail images and sounds (THOUSANDS) features ‘familiar to children’ letter, number and word clue pictures or environmental print. The PROMPTZ© collection features notebooks: A-Z Letterz, Blendz, Sight Wordz, (HFW), Numberz, and Storybookz, and Wigglez-(animated ) and Vibez-(audio) Additionally, there are a myriad of pre-made PROMPTZ Reading Activitiez and Math Activitiez and lessons, activities, flash cards, Bingo games and much more!

Purpose-Legal Authorization ‘Intent to Use’ Trademark-Logos-Copyright
The ‘Copyright Act’ sets out four factors the courts consider in trademark infringement cases: (17 U.S.C. § 107)
‘PROMPTZ©’ uses the mark in a “non-trademark manner” and not as a source identifier of the work, is ’Non-competing/ Non-confusing’. Selling ‘PROMPTZ© goods and/or services does not remotely “compete with” or “cause dilution to” those of the mark owner and strong evidence exists that consumers will not be ’confused’, no infringement exists. Since ‘PROMPTZ© serve a “different audience or purpose” using trademarks in this manner shall be considered “Fair Use”. Providing links to the trademark owner will totally eliminate a ‘substitution’ effect.
‘PROMPTZ© purpose and character is one of “Transformative Use”. The law favors, and courts have said that “putting a piece of an existing work into a new context” (such as a thumbnail in an image search engine) counts as “Transformative Use”. The “compilation” is a work formed by the collection and assembling of pre-existing materials and data has been selected, coordinated, and arranged in such a way that the resulting work as a whole constitutes an ’original work of authorship’ ‘PROMPTZ©. The term “compilation” includes collective works and images are subject to the same copyright and ‘fair use’ laws as written materials therefore, the same ‘fair use’ factors apply.
‘PROMPTZ© use of all trademarks has been rendered in ’good faith’. Under the “fair use” law, consideration is made as to ‘whether’ or ‘if’ the use of trademark is “non-disparaging”. The effect on the market or potential market has not ‘diminished’ or been compromised in any way.
‘PROMPTZ© use of the trademark is ‘Incidental’. No appearance exists that the trademark owner and author-publisher are associates of one another. The use of trademarks expressly refers to the owners so consumers will not be ’confused’ about or why the trademark was chosen (recognition factor and application value of its letters, sounds, numbers to curriculum). Furthermore, there will be no reference as to use, value, comparison or significance of either the product or company. This ’incidental use’ of trademark (one of several thousand) is protected as well under ’Nominative Fair Use’.

Beyond ‘Fair Use-and Nominative Fair Use’: Remaining pertinent statues and laws: STATUTORY PERMISSION TO USE COPYRIGHTED AND TRADEMARK MATERIALS IN U.S. CLASSROOM
Section 110(1) of Title 17 of the United States Code grants a specific exemption from copyright and trademark laws for: performance or display of a work by instructors or pupils in the course of face-to face teaching activities of a nonprofit educational institution, in a classroom or similar place devoted to instruction. A public school or a non-profit educational institution may purchase a copy of a DVD or any other format and use it for instructional purposes in classrooms. Likewise, a teacher at a public school or non-profit educational institution may purchase the copy and use it in classroom instruction.
