Extraordinary Measures

~ Some schools were so concerned by the racial disparity in their suspensions that they enacted special rules to try and curb it.
~ Schools put a rule into effect that a black student could not be suspended without the personal approval of the Superintendent of Schools (or some other high placed figure). ~ This rule had serious constitutional problems though. There is an equal protection of the laws provision in the Constitution. Treating one group differently from others typically violates that provision.
~ To solve the constitutional problem, some schools took it a step further. They completely stopped suspending ANY students for “willful defiance.”
~ In the 2015–16 school year, 23 of the 100 largest school districts nationwide required non-punitive discipline strategies and/or limits to the use of suspensions.
~ Schools are also realizing that they must take exigent circumstances into consideration for their overall discipline policy. For example, students who were Hurricane Katrina evacuees returned to their schools with behavior problems, such as short-term increases in school absences and discipline problems. A Zero Tolerance policy would be the worst possible “solution” for such a scenario.

Denver Schools Lessen Reliance on Police

~ As schools increased their reliance on police officers, they noticed dramatic increases in referrals to juvenile court for school-based offenses. The problem was that police have a different mind set from the schools. They want to find and arrest culprits. Then they hand them over to the appropriate prosecutor and the prosecutor takes it from there. For these cases, it would be the Juvenile Court used instead of the adult criminal courts. But that was the only difference.

~ The Denver Public Schools experienced this phenomenon. After the Columbine school shooting, Denver Public Schools (DPS) increased the police it used in its schools. By 2004, they noticed, to their horror, that the number of students referred to the court system had increased by over 70%. 42% of these were for minor offenses. The police did not understand that the school had parents to deal with and could not take this adversarial a stance against them, especially over minor offenses.
